Exclusive: SnagFilms Snags $10 Million in Funding at $50 Million Valuation

SnagFilms, the online video distribution site for professional documentaries, has nabbed $10 million in funding from Comcast’s investment arm and New Enterprise Associates, and will also now be distributing fictional independent film releases.

That and the new investment giving SnagFilms a valuation of $50 million should be big news at the 11th Sundance Film Festival, the famous independent film gathering opening in Park City, Utah, on Thursday.

And SnagFilms also announced that well-known industry exec Bingham Ray is joining the start-up to spearhead its distribution of fictional narrative and foreign-produced independent films.

The service, unlike the subscription-based video giant Netflix, currently distributes free non-fiction documentary films with advertising, as well as offers rental streaming and purchase options.

And it is profitable, said Ted Leonsis, the former AOL exec who is the founder and has been the driving investor in SnagFilms.

“It was always my personal frustration as a backer of documentaries that you could not get distribution far and wide,” he said in an interview earlier today.

He noted that while Netflix is really now focused on big studio fare, “what we’ve discovered is a big supply of independent video that has never seen light of day, but that has a big audience.”

SnagFilms’ strategy is to give broader reach to these films, which often don’t even have a theatrical opening–or, if they do, are very small.

Along with its site, which digitizes the films and adds advertising to them, SnagFilms also encourages Web sites and others to grab films and create a “virtual movie theater.” (You can see my effort below.)

It also has video-on-demand deals with Comcast, Verizon and more, as well as purchase options with Apple’s iTunes and others.

Earlier this month, SnagFilms also launched an impressive and free iPad full-movie-watching app.

SnagFilms also owns a popular news site called indieWIRE, which covers the independent film market, and the new funding will also be used to expand it.

That market has been in need of a boost of some kind, since it has been struggling as financing has dried up for the production of quality documentaries and outside-the-Hollywood-machine movies.

It has long been hoped that the Internet would perhaps save and strengthen the genre, with its supposed long-tail magic.

But the going has been slow. Currently, SnagFilms has 2,000 films in its online library, although Leonsis said the aim is to use the new funds to get 10,000 films on the service as soon as possible.

“We’re trying to build a beachhead in the independent film world,” he said of SnagFilms, which currently has about 40 employees in Washington, D.C., and New York. “We think we have a niche and video is the killer app on Web now.”

Leonsis, who has backed such notable documentaries as “The Rape of Nanking,” said NEA’s Peter Barris will join the board, along with existing investor Steve Case.

Case and Leonsis, of course, were the dynamic duo of AOL’s glory days.

So, I am rooting for another win in an arena that needs it.

In Yet Another Content Hook-Up, AOL Strikes Deal With Endemol

AOL’s strategy to partner with third-party content creators for original programming–especially premium video content–keeps ticking, with another partnership, this time with Endemol USA.

The New York-based Internet company said it would “co-develop and co-produce new Web programming initially aimed at AOL’s growing women’s audience” with Endemol.

Endemol makes television shows, such as “Extreme Makeover: Home Edition,” “Big Brother,” “Wipeout” and “Jerseylicious,” as well as Web series “Married On My Space 1 & 2″ and “Coupon Mom.”

AOL is working on several other content partnerships, said sources, to add to its previous ones.

AOL said the first two “built-if-sold”–meaning some big advertiser has to pony up–will be:

“Re-Dressed by America”: An interactive Web series where online users make over subjects facing a life-changing event (high school reunions, first dates, etc.) by voting on their hairstyles, fashion, accessories and more. The series will be featured on Stylelist.com and MyDaily.com.

“Mamá’s Recipe”: U.S. families compete for the best family recipes and share their secrets with the AOL audience. The series will be featured on KitchenDaily and AOL Latino.

Not exactly “The Sopranos,” but there you have it.

Twitter CEO Dick Costolo (¡Olé!)

Yes, like a digital Heidi Klum, Twitter CEO Dick Costolo did declare that BoomTown’s outfit was “matador casual” at the start of an interview I did with him at D@CES last Friday.

The event, which we did in cooperation with the Consumer Electronics Show, was only three sessions in one afternoon. It was followed by a lovely party, all at the Venetian Hotel in Las Vegas.

Here’s a longish highlights video of my interview with Costolo, during which we talked about a wide range of issues facing the San Francisco microblogging service, as well as his take on my fashion choice.

But let it be said, while I did not comment on his sartorial selection at the time, as you will see below, Costolo really did pull off a very smart approximation of an Ellen DeGeneres look himself.

Lady Gaga + 126,000 Pasty Geeks + Vegas = BoomTown Nirvana

This is going to be good.

The iconic singer and performance artist Lady Gaga will be appearing at the Consumer Electronics Show later today to unveil “creations” she came up with for Polaroid.

Gaga announced last year here that she had been named the creative director of Polaroid.

As part of the collaboration that will debut her Polaroid “Grey Label” project, Gaga said a year ago that she would be coming up with “prototypes in marrying the fields of fashion/technology/photography innovation.”

Oh, goody. Fishnet stockings that can post pictures to Instagram!

I am considering going to the event–as ordered to by the shy and retiring Hollywood agent Ari Emanuel.

But it will likely be a mosh pit of nerdy dudes, so I’ll need to frontload starting at 10 am.

Déjà Vu: Facebook’s Questionable Stock Hijinks Feels Like Winklevii 2.0

Many years ago, before Google went public, I had an unusual late-night conversation in the lobby of the TED conference with its co-founder Larry Page about the prospect, about which–despite its inevitability–he had more than a little nervousness.

That would be: Taking the search company public.

After much ruminating, Page concluded that one of the more important reasons he felt compelled to have an IPO was to finally reward Google’s employees for all the work they had done to build the company.

While I have never had a similar chat with Facebook CEO Mark Zuckerberg about the powerful social networking company and an initial public offering, I suspect that he would not express any such sentiment.

And it’s not because Zuckerberg does not value his staffers any less than Page did–instead, it’s because he seems to value his privacy most of all.

I know–ironic!–given how many perceive the company to be cavalier about important issues related to disclosures of personal information uploaded to Facebook by the mountain-load daily by its hundreds of millions of users.

That aside, Zuckerberg’s clear intent to keep the lid on Facebook tight–with no information about the details of financial performance and other pertinent information a public offering would require be disclosed–is clearly about to become a nettlesome issue for the company.

While that effort at preserving secrecy by staying private has resulted in little more than cute Silicon Valley media guessing games about a possible IPO, its most recent machinations are too clever by a half.

That would be the new and giant investment from Goldman Sachs, as well as a deal to get $1.5 billion of pre-IPO shares in the hands of the investment bank’s rich customers.

Aside from the appalling image that only the very wealthy can get an early shot at Facebook shares, which instantly became a press meme yesterday after the Goldman deal was announced, pretending this single investment entity–called a “special purpose vehicle”–simply feels like a Wall Street trick.

Plus, a special purpose vehicle sounds like a car that bankers use to take people for a ride.

Thus, a gaggle of rich doctors in New Jersey are treated like one blob, instead of what is plainly true to all. As the old Latin legal phrase goes: Res ipsa loquitur (the thing speaks for itself).

Of course, this strategic move is designed to keep the number of primary stockholders under 500, which is the IPO tipping point for the Securities and Exchange Commission.

Therefore, by all means, let’s do it!

Or not, because I had an intense déjà vu about all this, and an unease that it felt vaguely familiar as a negative characteristic of Zuckerberg’s leadership that seems to cling to him.

That would be the dicey origins of Facebook, which remain a controversy to this day, including garnering an entire Hollywood movie on the subject.

Anyone with a passing knowledge of Facebook’s history knows the basic question: Did Mark Zuckerberg “steal” the idea for Facebook from the Winklevoss twins, as well as sandbag their efforts, while they were all students at Harvard University?

And, more to the point, was it illegal?

The Winklevii certainly think so, continuing in their Don Quixote quest to take Zuckerberg down in a series of ever-more-comical lawsuits.

For me, the answer is a lot more complex–I think Zuckerberg most definitely screwed with the Olympic rowing twins and it was very creepy that he did.

But, in terms of breaking the law, not so much.

Of course, if you are endeavoring to always act with ethics in your career, this should not be the bar set. But in practical terms, it was most definitely an aggressive knee-capping that is not uncommon in business.

Zuckerberg has shown similar tendencies many times since then, especially around the thorny issues of privacy, where fast-and-loose behaviors are quickly followed by the I’m-sorry-I-didn’t-mean-it excuses.

Okay, fine, I get it. Business is war.

But, as it moves into a more mature place, the question now is whether Facebook should keep stressing this kind of wink-wink-nudge-nudge propensity, because it feels–how can I say this in the nicest way–icky.

Plus it will surely attract unneeded attention from the SEC, which is already looking into the opaque market for trading shares of closely held companies and where Facebook is the star attraction.

And this is to say nothing of other issues–for example, could there be insider trading problems around the buying and selling of these private shares, as one person close to the situation has noted to me?

Facebook, of course, will defend what it is doing as above board, say it’s not unfair to give special access to its bounty to the very rich in what is essentially a private IPO and wag a finger at critics like me and tell us we don’t understand sophisticated financial issues.

But here’s what I grok without a Harvard Business School degree: It feels sneaky, it feels elite, it feels opaque, and this kind of fancy financing footwork could end in tears.

Because these legitimate questions on how Facebook handles its stock will continue to dog the company until–when he is good and ready (and finances at Facebook look prettier)–Zuckerberg eventually pulls the trigger on an IPO.

It would be nice, even if Wall Street applauds his cleverness, if he didn’t keep shooting himself in the foot along the way.
